Research on the Benefit Compensation Mechanism in Intellectual Property Rights of Start-ups
The IP innovation and protection of start-ups involves multiple interest bodies,a well-developed benefit compensation mechanism is an important way to alleviate the imbalance in benefit distribution,tap into social innovation capabilities,and improve in-novation efficiency and achievement transformation effects.This article elaborates on the legal legitimacy and necessity of applying the benefit compensation system in the field of intellectual property and analyzes the main difficulties faced by the application of the benefit compensation system in the creation,utilization,and protection of intellectual products in start-ups,including the simplification of the way to balance conflicting interests,the imbalance of benefit compensation in internal R&D of start-ups,and the unreasonable rules of benefit allocation and compensation in IP cooperative innovation.Then it proposes ideas of constructing a optimized benefit compensa-tion mechanism to promote the growth and development of start-ups from the perspective of advocating the co-existence of weak protec-tion of intellectual property and compensation for the interests of rights holders,establishing and improving the compensation mecha-nism for the interests of service innovators,constructing the compensation and incentive mechanism for cooperative innovation.
