Internal Logic,Possible Risks and Comprehensive Regulation of Digital Intelligence Empowerment in the Optimization of National Innovation System
The achievements of new generation generative artificial intelligence in the national innovation sys-tem scenario are remarkable,and the coupling of the two in the absence of law is worrisome and needs to be addressed prudently.As a synthesis of experience,the new generation of generative AI to achieve overall effi-ciency based on the optimisation of traditional production modes and factors,to promote the optimisation of specific management factors to expand the co-ordination capacity at the national level,and to boost the intelli-gence of innovation factors and trigger the bursting discovery of new innovations are the realistic factors for it to gain a foothold in the national innovation system.However,there are reasons for the absence of the rule of law.First,the black box of algorithms has caused the intrusion of data rights and ethical crisis.Second,the lack of consensus has led to the destabilisation of cultural security and the expansion of digital hegemony.Third,the failure of the existing rules has manifested itself in the difficulties of copyright ownership and trans-formation of achievements in practice.Therefore,the construction of the national innovation system for the new generation of generative AI should be operated within the legal system,based on the legal system of data pro-tection,supplemented by the legal system of consensus condensation,improved by the law of intellectual prop-erty as the main point,supported by the legal field of industrial structure,and assisted by supporting measures of talent cultivation.
