The Generative Basis and the Guarantee of Rule of Law for Digital Rights
The core feature of the digital era is the state of"digital existence"of human beings.Digital space,digital attributes,and digital interests constitute the real basis of digital rights,and also carry the demands of the digital rights of the times.However,insufficient legal recognition of digital rights,limited public protection of digital rights,poor judicial remedies for digital rights,and lack of balanced protection of digital rights have resulted from the inadequacy of systems or mechanisms such as digital rules,digital administration,digital jus-tice and digital platforms,which led to the systematic"loss"of digital rights.Therefore,it is urgent to strengthen the legal confirmation of digital rights,promote the public security of digital rights,improve the judicial relief of digital rights,and enhance the balanced protection of digital rights,so as to curb the problem of"loss"of digital rights,and provide the rule of law guarantee for the protection of digital rights.
