On the Mediation-based Administrative Review Model with Chinese Characteristics
The inclusion of the principle of mediation in the provisions of the General Principles is one of the highlights of the revision of the Administrative Review Law,which heralds the generation of a mediation-based administrative review model with Chinese characteristics.Resolving conflicts and disputes in accor-dance with the law has become the responsibility of governments at all levels.The substantive resolution of administrative disputes has become an emerging political and legal discourse,and the status of review as the main channel for resolving administrative disputes has been realized,which together constitute the social back-ground of the mediation-based administrative review model of Chinese characteristics.In terms of normative connotation,mediation priority and maximum mediation are the basic qualities of the new model.Mediation covers all types of administrative review cases,throughout the whole process of administrative review,media-tion settlement and effectiveness of diversification,which is the core of the new model.The effective operation of the mediation-based administrative review model with Chinese characteristics needs to be ensured by strengthening the capacity of administrative review personnel,establishing a scientific evaluation system,and making full use of internal and external forces.The development of mediation-based administrative review model with Chinese characteristics will reshape the overall pattern of administrative dispute resolution and fur-ther promote the modernization of national governance system and governance capacity.
