The Institutional Advantages and Efficiency Optimization of Incidental Review in Administrative Review
The newly revised Administrative Review Law of 2023 actively responds to the theoretical contro-versy and practical needs.It updates and optimizes the system of incidental review of normative documents in three aspects,namely,unifying the academic concepts,expanding the scope of review and clarifying the review effectiveness.Compared with the filing review,administrative litigation incidental review and other systems,administrative review incidental review in the hierarchical supervision,professional review,case radiation and the source of governance has a unique system advantages.In order to carry out the implementation of the Administrative Review Law and optimize the efficacy of the incidental review system,the next step needs to clarify the core elements of the review in the supporting system,to connect the review procedures and results in the system articulation,to strengthen the role of case guidance in the disclosure mechanism,and to estab-lish the independent review system in the reform advancement,so as to further activate the systemic advan-tages of the administrative review incidental review in the supervision of normative documents.
