大数据不正当竞争行为的法律规制问题研究

摘要
数字经济时代,大数据已经成为互联网平台的核心竞争力.大数据同时也是一把"双刃剑",一方面为经济高质量发展注入强大动能,另一方面也催生出"算法歧视""大数据杀熟"等市场乱象,这些市场乱象都是大数据不正当竞争行为的表现.对大数据不正当竞争行为的法律规制有大数据算法设计规制和消费者个人数据产权规制两种进路.大数据算法设计规制的实现需要建立算法责任制度,成立算法责任审查委员会.消费者个人数据产权规制的实现需要确立经营者等数据使用人的消费者个人信息隐身份义务,保证消费者个人信息被遗忘权.
Abstract
In the era of digital economy,big data has become the core competitiveness of Internet platforms.At the same time,big data is also a"double-edged sword".On the one hand,it injects strong momentum into high-quality economic development,and on the other hand,it also produces market chaos such as"algorithmic discrimination"and"big data killing".These market chaos are the manifestations of unfair competition of big data.There are two ways to regulate unfair competition in big data:big data algorithm design regulation and consumer personal data property regulation.The realization of big data algorithm design regulation requires the establishment of algorithm responsibility system and algorithm responsibility review committee.The realization of the property regulation of consumer personal data needs to establish the hidden identity obligation of consumer personal information of data users,and ensure the right of consumers'personal information to be forgotten.
