摘要
回顾近年来国内的法社会学研究,无论是在主要议题、研究进路、理论资源、展开方法,还是定位认识等方面都有了不少积累,但还需要有更新、更深的探索,这不仅是为了深植自身的根基与拓展研究的疆域,也是为了回应各种批评与质疑.面对来自外部的质疑和批评,法社会学不仅需要在相互论辩中明晰相关问题、主动反思和回应其中的一些误区,还需要拿出具有自身风格的具体作品以展示法社会学的实际价值.在内部,究其实质,法社会学研究是一种"社会—法律研究".这就需要不断增进关于"社会"本身的认识与辨析关于"法律"含义的理解.正是"社会"这个原点,为法社会学研究提供了源头活水,是以,"社会—法律研究"是我们需要不断返回的起点.
Abstract
When looking back on the research in sociology of law in China in recent years,abundant accumulation has been made,which covers not only the researches on the major themes,research approaches,theoretical resources and methodology,but also the understanding to the orientation of this discipline.However,there is still a need for more updating and deeper exploration,which is not only to deepen its own foundation and expand its scope of research,but also to respond to various criticisms and doubts arisen.When facing doubts and criticisms from the outside,sociology of law not only needs to clarify relevant issues through debating with each other,especially with active reflection and clarifications on some misunderstandings,but also needs to produce specific works with its own style to demonstrate the actual value of sociology of law.Furthermore,inside itself,the research on sociology of law,in essence,is a form of"socio-legal studies".Thus,this requires continuously enhancing the understanding of"society"itself and the analysis on the meaning of"law".It is,exactly,the"society"as the original point that provides a source of vitality for the study of sociology of law.Therefore,"socio-legal studies"is the starting point that we need to keep returning to the society.
