我国人格权研究的可视化知识图谱分析——基于CNKI的数据(1992～2020年)

摘要
人格权研究是我国学术研究的热门领域之一.以中国知网1920篇人格权研究的高质量文献为样本数据,运用CiteSpace可视化软件对其进行定量分析.研究发现:近30年来,我国人格权研究成果数量总体呈增长之势,研究者与研究机构主要来自法学领域,尚未形成合作研究氛围;人格权研究主题聚集在4个重点知识群,即"人格权历史发展与立法研究""人格权权利类型研究""人格权商品化研究""人格权侵权责任研究";人格权研究经历了早期起步、爆发增长和稳步发展3个阶段,人格权立法、个人信息保护与数据权问题是学界重点关注的学术前沿.我国人格权研究在人格权立法、司法和学术传承方面均有贡献,但也存在不足之处,未来人格权研究应坚持研究方法的多元化与实证化;深入开展人格权基础理论研究,建构我国人格权理论体系;与时俱进,研究新兴科技发展对传统人格权理论的挑战及其应对,以及推动建立人格权科研团队,促进研究者、研究机构之间的合作与交流.
Abstract
Personality rights is one of the hot areas in Chinese academic research.There is a quantitative analysis on high-quality literatures on personality rights selected from CNKI by using of CiteSpace visualization software,and the results show as follow.In recent thirty years,the number of researches on personality rights in China has been on the rise in general;researchers and research institutions are mainly from the field of law,and they have not formed collaborative research teams yet;the themes of personality rights studies focus primarily on four knowledge areas,namely,"historical development of personality rights and its legislation","the typology of personality rights","the com-modification of personality rights"and"the tort liability of personality rights";personality rights studies in China have gone through three phases:the early-start,explosive growth and steady development,and"personal rights legislation","personal information protection"and"data rights"would continue to be a hot topic in Chinese academic area.The studies of personality rights in our country have contributed to both legislative and judicial aspects of personality rights,but they also have shortcomings.In the future,actions should be taken to improve the level of personality rights studies,such as insist on the diversification and empiricalization of research methods;carry out in-depth research on the basic theories of personality rights and construct a theoretical system of personality rights in China;keep pace with the times and study the challenges posed by the development of emerging technologies to traditional personality rights theories and their responses;and promote the establishment of research teams on personality rights and promote cooperation and exchanges among researchers and research institutions.
