摘要

从郭宝昌、陶庆梅的《了不起的游戏:京剧究竟好在哪儿》一书切入,讨论京剧现代化及其所面临的困难,进而思考传统再造及文化主体性问题.从戏剧美学符号表征冲突角度讨论京剧的国粹与国渣之争,指出可通过纯粹美学符号的"能指"来表达代表文明趋同性价值的"所指".从表演体系角度来看,晚近西方表演体系遭遇播化困难,斯坦尼斯拉夫斯基体系和布莱希特体系都无法概括京剧表演体系."林毓生悖论"忽视了中国文化的主体性,重构京剧主体性应以传统再造为前提.由"剧"及"法",晚近法制现代化所面临的问题与京剧现代化相同,重构中国法的主体性应如现代京剧革命一样,立足固有法传统开放地借鉴世界法治文明的共同遗产,将其创造性转化并植入本国法传统.

Abstract

Starting from the works of Guo Baochang and Tao Qingmei,it discusses the modernization of Peking Opera and the difficulties it faces,and then considers the issues of traditional reconstruction and cultural subjectivity.Discuss the debate between the good and the bad of Peking Opera from the perspective of the conflict between the symbolic representation of drama aesthetics,and points out that the"signified"representing the convergent value of civilizations can be expressed through the"signifier"of purely aesthetic symbols.From the perspective of the performance system,the western performance system has recently encountered the dilemma of broadcasting,and neither the Stanislavsky system nor the Brecht system can accurately summarize the performance system of Peking Opera.Model opera means that the formation of Peking Opera tradition is a process that is constantly shaped by layers.The Lin Yusheng Paradox ignores the subjectivity of Chinese culture,and the reconstruction of the subjectivity of Peking Opera should be based on the reconstruction of tradition.From"drama"to"law",the modernization of the legal system is the same as the modernization of Peking Opera.Reconstructing the subjectivity of Chinese law should be like the modern Peking Opera revolution.At present,based on the inherent legal tradition,we should openly absorb the common heritage of the world's rule of law civilization,transform it creatively and implant it into the domestic legal tradition.
