The Theoretical Reflection and Institutional Improvement of Reporting System in Cyberspace

摘要
网络举报能在一定程度上化解政府与平台治理互联网的信息与资源困难,并保护用户的个人信息与言论自由权利.但由于用户的信息、知识与意志局限性,其辅助治理作用发挥不足,而用户赋权过重又导致这一制度可能被滥用为个别用户打压异见、网络群体相互攻击的工具.前述功能与实效的差距,体现出法律对社会规范的替代使二者的合理分工格局被打破,并且因为治理手段的融合而难以通过替代性纠纷解决方式来克服.然而,用户参与互联网治理的原则应坚持,一方面利用技术辅助用户从而增强制度功效,另一方面通过法律惩治滥用从而减轻制度问题.
Abstract
Online report system not only relieves the shortage of information and resources in the Internet governance of governments and platforms,but also protects the personal information and freedom of speech of Internet users.But due to user's lack of information,knowledge and will,the system functions inefficiently.And over technological empowerment of users leads the system to be the tool for dissent oppression and group confrontation for particular users.The aforementioned gap between function and effectiveness reflects the disorder of the two as a result of the substitution of law for social norms,which is difficult to overcome by using alternative dispute resolution schemes due to the convergence of governance.However,we should insist on the principle of user participation in Internet governance by technologically assisting them and legally punishing abuses.
