在数字经济时代,平台反垄断需要走向多元共治,同时秉持"预防式"和"回应式"的治理理念.预防式治理是为了预防平台新型垄断的风险,回应式治理则旨在回应市场需求的政府监管思路.在两者并重的基础上,从平台自治、社会监督和政府监管三个层面构建平台反垄断多元共治的新局面.对于平台企业来说,平台公共性与平台自治权相生相伴,"超级平台"应承担"超级合规义务",以企业自治的方式从源头预防垄断行为发生.为回应市场需求,社会监督也需要在鼓励与开放中得以补足,鼓励第三方评估和行业研究,推进涉及市场竞争领域的公益诉讼.最后,有为政府应以市场为起点和尺度,合理设置前置式的政府柔性干预,并不断提升数字化行政能力,转向智慧化的反垄断监管模式.
Abstract
In the era of digital economy,in order to cope with the possible regulatory failure caused by the traditional"government-centered regulation"model,the platform anti-monopoly needs to move towards pluralistic co-governance,meanwhile adhering to the concepts of"preventive"and"responsive"governance.Preventive governance is to prevent the risk of new types of platform monopolies,while responsive governance is a regulatory thinking of responding to market demands.On the basis of both above,a pluralistic co-governance situation of platform anti-monopoly is built on three pillars:platform autonomy,social supervision and government regulation.For platform enterprises,the public nature of platforms is closely related to platforms'autonomy.The"super platform"should assume"super compliance obligations"and prevent monopolies at source through corporate autonomy.In order to meet market demands,social supervision needs to be reinforced in the process of encouragement and openness,with advancing third-party evaluation and industry study,and promoting public interest litigation in the field of market competition.Finally,the government should take the market demand as the starting point and scale,reasonably set up flexible government interventions,continuously improve their digital administrative capabilities,and transform to a regulatory model of smart government on platform anti-monopoly.
