基本权利第三人效力的释义学基础不是单一的构造,而是多层的构造.以公私融合关系为基点,基本权利第三人效力的释义学基础涵盖四个方面的内容:政治国家与市域社会的融合关系以及国家宪法与社会宪法的复合模式,构成了基本权利第三人效力的宪制基础;基本权利的涵括与排除、给付请求与积极受益功能,构成了基本权利第三人效力的功能法基础;宪法/公法与私法的相互影响使宪法与私法具有了同一性内容,构成了基本权利第三人效力的实体法基础;民事诉讼程序的宪法化、民事诉讼公私二元的三角法律结构、诉权在民事诉讼中的公私二元结构,构成了基本权利第三人效力的程序法基础.基本权利第三人效力注重个人自由与个体在共同体中的自由之间的协调,目的在于消解社会的结构性不正义.基本权利第三人效力具有多元法律关系的复合性和多元法律主体的统一性,是一种整全性的实践.
Abstract
The doctrinal foundation of third-party effect of fundamental rights is not a single structure,but a multi-layered structure.The integration of political state and civil society,as well as the compound mode of national constitution and social constitution,constitute the constitutional basis of third-party effect of fundamental rights.The inclusion and exclusion,payment and benefit functions of the fundamental rights are the functional law foundation for third-party effect of fundamental rights.The social and mandatory provisions of private law,the identity of constitution and private law,and the coherence and openness of the internal system of private law constitute the substantive law basis for third-party effect of fundamental rights.The constitutionalisation of civil proceedings,the triangular legal structure of civil litigation,and the public-private dual structure of right of action are the basis of procedural law for third-party effect of fundamental rights.Third-party effect of fundamental rights focuses on the idea of a societal constitutionalism and a constitutionalisation without the state,aiming at dissolving the structural injustice of the society and guaranteeing the realization of the rights of the vulnerable groups.Third-party effect of fundamental rights has the complex nature of multiple legal relationships and the unity of multiple legal subjects,which is a comprehensive practice.
