在全民守法的宏观背景下,法律意识研究需超越微观行动情景,建立与大众文化相融的理论结构.规范性的合法性认同与价值性的守法道德观念是守法意识内涵的双重面向,在大众文化场域中展开为"法律价值积累与意义选择""法律意识形态与集体无意识""法律精英与法盲"3组关系,塑造了作为感觉结构的守法意识模式.大众法律文化是从守法观察法治的独特视域窗口,其所遵循的创造性破坏机制,有助于理解现代社会中法律意识"在流行中消解"的悖论式特征,为普法、法律意识和法律传播等相关经验研究与中国法治实践提供一个新的思考框架.
Abstract
Under the macro background of law-abiding for all people in the country,the study of legal consciousness needs to transcend micro action scenarios and establish a theoretical structure that is compatible with popular culture.The normative identity of legality and the value of law-abiding morality are the two sides of the connotation of law-abiding consciousness,which are developed into three groups of relations in the field of popular culture,such as"accumulation of legal value and choice of meaning","legal ideology and collective unconscious","legal elite and legal illiteracy",etc.,which shape the structure of sensation as the structure of feeling.The relationship between the legal elite and legal illiteracy has shaped the mode of law-abiding consciousness as a sensory structure.Popular culture is a unique window to observe the rule of law from the law-abiding perspective,and the creative destructive mechanism it follows helps to understand the paradoxical feature of"dissolving in popularity"of legal consciousness in modern society,and provides a new thinking framework for empirical research on law popularization,legal consciousness and legal dissemination,as well as for the practice of the rule of law in China.
