Legitimacy of Existence of Judicial Confirmation System Under Administrative Nature of Consultation on Compensation for Ecological and Environmental Damage
We should view the first application of judicial confirmation system in the public welfare field from a new perspective.Macroscopically,on the premise that the administrative nature of the consultation on ecological and environmental damage compensation is confirmed,it is clear that the judicial confirmation system serves as one of the supporting enforcement mechanisms of relevant laws,the existence of which ensures the timeliness of the performance of the compensation agreement,and does not have civil or administrative nature.Microcosmically,based on the judicial confirmation system and the ecological and environmental damage compensation consultation system,this paper explored the establishment purpose of the judicial confirmation system,combined with the latest laws,and focused on the new flexible enforcement means of administrative law,the"consultative administration"in the field of consultation on ecological and environmental damage compensation,providing theoretical support for the existence of judicial confirmation system under the administrative nature of ecological consultation.
