Research on Judicial Application of Carbon Sink Subscription Under the Background of"Carbon Peaking and Carbon Neutrality"Goals-Based on 40 Ecological and Environmental Litigation Cases
The guidance of policies and norms and the guarantee of the legal system are two important tasks to drive the realization of the"carbon peaking and carbon neutrality"goals.As a key link in the"carbon peaking and carbon neutrality"legal system,the judicial service guarantee mechanism innovatively introduces the means of"carbon sink subscription".As an alternative restoration measure for the ecological environment,carbon sink subscription is not only in line with the current"carbon peaking and carbon neutrality"goals of China,but also can make up for the actual shortages of direct restoration of the ecological environment.Based on 40 ecological and environmental litigation cases,it is believed that the judicial application of carbon sink subscription can be improved from three dimensions:defining the judicial application field of carbon sink subscription,and expanding from forestry carbon sink to other fields;clarifying the judicial application status of carbon sink subscription,and taking carbon sinks as a direct unit of measurement;and refining the specific mechanism for carbon sink subscriptions and improving the entire process supervision and management system.
