Under the circumstances of worrying natural population growth rate and national encouragement of childbirth in China,the reproductive rights of single women have once again become a focus of attention.The controversy surrounding this issue has a long history.At present,most scholars support granting reproductive rights to single women,but some oppos-ing views on granting reproductive rights to single women have not been comprehensively and systematically analyzed,and their scientific validity is questionable.One representative point is the viewpoint of researcher Chen Xiangjian in his article"Questioning the Reproductive Rights of Single Women.".The article believes that granting single women the reproductive rights will bring the following problems:firstly,the issue of child fairness cannot be solved,and secondly,it cannot guaran-tee equal access to reproductive rights for single men and women;thirdly,it is not conducive to the growth of children born to single women and hinders their freedom of marriage.These views mainly have the following shortcomings:firstly,they con-tradict the principle of equality stipulated in the Constitution,and the view that children have the legal right to have both par-ents has no legal basis;secondly,the statement that the reproductive rights of single men and single women cannot be bal-anced is biased;thirdly,the view that granting single women reproductive rights is not conducive to the growth of such mi-nors and hinders the single women's freedom of marriage is not in line with the facts,moral,and law.
