Practical Dilemmas and Breakthroughs in the Procedural Disposal of Virtual Currencies in Criminal Cases:A Focus on the Criminal Investigation Stage
Criminal case-related virtual currencies represent a new form of digital-era seized assets.Their charac-teristics of decentralization and anonymity challenge existing practices for the handling of seized assets, leading to prac-tical difficulties such as the failure of traditional methods for controlling assets, difficulties in ensuring the effective custody and quality, and questions about the legitimacy of preliminary disposal practices. Therefore,it is necessary to rely on improving the professional expertise of investigators, adjust the control and investigation methods for case-relat-ed virtual currencies, draw upon the latest techniques for electronic data forensics, and apply technical means,prose-cutorial review, and restrictions on preliminary disposal to establish a dual-evidence collection model for case-related virtual currencies. In addition,a digital asset management center for seized assets should be established to enhance specialized management of seized virtual assets, thereby breaking through the current procedural challenges in dispos-ing of case-related virtual currencies.
