论双边投资条约中的国民待遇制度及其新发展

摘要
随着国际经济的发展,20世纪末在投资领域兴起了“准入前国民待遇”的热潮,“准入前国民待遇+负面清单”的外资管理模式已逐渐成为国际投资领域的新趋势。在全球贸易投资规则重构的背景下,中国必须借鉴国际通行的作法,根据我国经济发展状况及对外投资和引进外资的战略要求,应对“准入前国民待遇+负面清单”投资管理模式。
Abstract
With the development of international economy,pre-establishment national treat-ment becomes a boom in the field of investment at the end of the 20th century.The foreign in-vestment management mode of“pre-establishment national treatment + negative list”has gradu-ally become a new trend of international investment field.Under the background of reconstruc-tion of rules of global trade and investment,China should follow international practice.Based on China’s economic development and demand of investing abroad and attracting foreign invest-ment,investment management mode of “pre-establishment national treatment + negative list”should be adopted.
