A Study on the Application of the Legal Rule of Assumption of Risk in Sports
Aiming at the background of the formal implementation of the legal rule of assumption of risk,sorting out and summarizing the theories and practical experience in the legal application of sports injury disputes in the past,exploring the factors that need to be considered in the application of self-contained risk rules from the aspects of contract freedom and personal rights protection,obligation standards and subject specificity,risk self-assurance and guarantee supplementary mechanisms,and proposing that on the basis of the existing system,accelerating the legal rule of assumption of risk,improving the sports injury protection mechanism,establishing a diversified dispute resolution mechanism,and promoting the reasonable and effective application of the legal rule of assumption of risk in the sports field.
