案例推理系统采取符号主义的路径进行法律人工智能建模,运用逻辑学的方法刻画案例推理的过程,但是,传统逻辑工具难以对案例推理过程中的可废止过程进行刻画和表达.运用论证理论中的论证型式工具,对经典案例推理系统海波的工作原理进行解析,可重构案例推理系统的逻辑模型,明确案例推理系统的智能界限.基于案例推理系统逻辑模型的解析,反思当下司法实践中的类案系统,可证立人工智能辅助司法的基本原则.
Abstract
Case-based reasoning system takes a symbolic path to model legal artificial intelligence,use logic to portray the process of case-based reasoning.However,traditional logic tools are difficult to portray and express the defeasible process in the case-based reasoning process.The logical model of the case-based reasoning system can be reconstructed,and the intelligent boundaries of the case-based reasoning system can be clarified,as using the tools of argumentation schemes in argumentation theory to parse the working principle of the classical case-based reasoning system Hypo.The reflection on the similar-case systems in the current judicial practice,which is based on the analysis of the logical model of the case-based reasoning system,can prove the basic principle of artificial intelligence-assisted justice.
