论自动化行政正当性的实现

摘要
在数智化社会中,传统的社会生活方式被重新定义,自动化的行政手段获得了新的作用空间和支配方式,算法权力与算法权利之间的张力正在成为自动化行政新的时代命题.基于此,应当以自动化行政过程中所出现的问题为导向,通过对不同国家自动化行政风险控制方法的比较,建构一种更适合我国的自动化行政正当性控制模式.最后循着该模式分别从规范层面与执行层面提出我国自动化行政正当性实现的两条进路.
Abstract
In the digital intelligent society,the traditional social life style has been redefined,and the automatic administrative means have gained new function space and dominant mode.The tension between algorithm power and algorithm power is becoming a new proposition of the era of automatic administration.Based on this,we should take the problems in the process of the rise of automation administration as the guide,and compare the risk control methods of automation administration in different countries to construct a more suitable legitimacy control model of automation administration in China.Finally,following this model,two approaches to realize the legitimacy of automation administration in China are put forward from the normative level and the implementation level respectively.
