摘要
当前,涉网新型犯罪正处于势能集中释放期,社会危害性大,范围广,对人民群众生命财产安全造成严重威胁.然而,在打击治理涉网新型犯罪中,不仅存在侦查难、取证难、追赃难等突出问题,还存在罪名认定分歧与共犯故意认定的问题.涉网新型犯罪已成为全球性治理的重点和难题,提高涉网新型犯罪的治理效能迫在眉睫.对此,应调整侦查管辖制度,构建大侦查管辖格局;提高网络技术反制能力,筑牢网络安全防范阵地;聚焦个人信息保护,强化源头管控治理.如此,才能以更有力的措施、更高效的手段来打击涉网新型犯罪,以遏制涉网新型犯罪高发态势,不断提升涉网新型犯罪治理的成效.
Abstract
Currently,cybercrime cases are occurring in large numbers,posing extensive and significant social harm,seriously threatening the safety of people's lives and property.However,tackling cybercrime faces significant challenges such as difficulty in investigation,evidence collection,and asset recovery,as well as discrepancies in crime classification and the determination of accomplice intent.These crimes have become a global focus and a pressing issue,making it urgent to enhance governance effectiveness.Therefore,we shall establish a comprehensive investigative jurisdiction framework and enhance network countermeasures to fortify cybersecurity defenses and focus on personal information protection to strengthen source control.By doing so,more robust and efficient measures can be employed to combat cybercrime and curb its high incidence,thereby continuously improving governance effectiveness.
