Reconstruction of the Relationship Between Investigation and Prosecution in Plea Bargaining Cases
The comprehensive implementation of the leniency system for plea bargaining has promoted the repositioning of the relationships among investigation,prosecution,trial,and defense.In plea bargaining ca-ses,the investigation and prosecution stages are crucial.However,influenced by China's"assembly line"liti-gation structure,these cases still prioritize investigation,posing risks of power deviation in investigative and prosecutorial bodies.Therefore,the relationship between investigation and prosecution should be reconstructed to ensure effective collaboration during the pre-trial phase,creating an integrated prosecution framework.Ad-ditionally,the evidence standards for criminal charges should be improved,and mechanisms for investigative supervision and collaboration should be activated to facilitate positive interaction between investigation and prosecution in plea bargaining cases.
