道路交通事故车辆类型司法鉴定实践

摘要
随着我国经济的快速发展,交通通行的需求快速增加,用于上下班通勤及短距离运输及载客的需求尤为显著.两轮电动车、三轮电动车、四轮电动车、两轮燃油车、三轮燃油车等轮式车辆随处可见.交通事故发生后,涉案车辆是机动车还是非机动车,在道路交通事故责任认定中至关重要.文章以实际鉴定工作为背景,结合具体案例,具体分析鉴定工作中常见的两轮、三轮及四轮车属于机动车还是非机动车,旨在帮助解决交通事故处理中各方对车辆属性(类型)的不理解.
Abstract
With the rapid development of China's economy,the demand for transportation has increased rapidly,and the demand for commuting and short-distance transportation and carrying passengers is particularly significant.Two-wheeled electric vehicles,three-wheeled electric vehicles,four-wheeled electric vehicles,two-wheeled fuel vehicles,three-wheeled fuel vehicles and other wheeled vehicles can be seen everywhere.After a traffic accident,whether the vehicle involved is a motor vehicle or a non-motor vehicle is very important in the determination of road traffic accident liability.Based on the actual appraisal work and combined with specific cases,this paper analyzes whether the common two-wheeled,three-wheeled and four-wheeled vehicles in the appraisal work belong to motor vehicles or non-motor vehicles,aiming to help solve the misunderstanding of all parties in the handling of traffic accidents about the attributes(types)of vehicles.
