摘要
通过对294份裁判文书进行研究发现,著作权侵权惩罚性赔偿制度自运行以来,呈现摇摆适用、消极适用、机械适用和竞争适用等现象,反映制度存在功能定位不一、成本收益失衡、适用范围偏离、证明计算困难等问题,需要明确制度在多维度下的功能定位、激发制度的适用动力、回归制度的适用范围、破解制度的证明计算瓶颈,在打击著作权侵权过程中,用足用好惩罚性赔偿制度.
Abstract
Through the study of 294 judgments,it is found that since the implementation of the punitive compensation system for copyright infringement for more than two years,phenomena such as swing application,negative application,mechanical application and competitive application have emerged,showing such problems as inconsistent functional orientation,imbalance of costs and benefits,deviation in the scope of application,and difficulties in proof calculation.It is necessary to clarify the functional orientation in multiple dimensions,stimulate the applicability of the system,return the system to its appropriate scope of application,and overcome the bottleneck of proof calculation of the system.It is essential to fully and effectively utilize the punitive compensation system in the process of combating copyright infringement.
