The Logic of Economic Law's Governance on Generative Artificial Intelligence
The governance of generative artificial intelligence(AI)has gained widespread attention globally,with major countries strengthening economic legal frameworks in this field.However,China's governance of economic law in this domain has yet to receive adequate focus,and there exist multiple problems.The dual functions and unique system structure of economic law determine its indispensable role in governing artificial intelligence generated content(AIGC),especially on the competitions on international regulations related to this kind of AI.Effective economic law governance over AIGC should prioritize the fusion of development and security,emphasize systematic governance,and integrate proactive prevention with responsive measures alongside a mix of specialized and general regulatory rules.Leveraging the advantages of macroeconomic regulation and control laws and market regulation laws is essential in governing AIGC,adapting strategies to the varying complexities across different stages.In order to enhance the precision and efficiency of economic law governance,the establishment of a scientifically sound risk assessment mechanism for AIGC is imperative.
