The Dilemma and Institutional Response of Offline Protection of Workers in China
In the digital age,the offline protection of workers cannot be ignored.At present,it is not suitable for China to directly stipulate the right to go offline in legislation,but the labor law already has the realistic conditions for offline protection of workers,including the protection premise of the right to rest and a relatively adequate collective bargaining mechanism.Despite this,China's labor law does not respond adequately to the digital age,resulting in offline protection dilemmas such as repeated violations of workers'right to rest,difficulty in identifying"invisible overtime"as overtime,and failure to guarantee the right to occupational health and safety.Therefore,it is recommended to improve the rele-vant labor laws and norms,first,to improve the working hours system to protect the right of workers to rest;The second is to clarify the definition of working hours and include"invisible overtime"in the scope of overtime identification;The third is to start from the two aspects of occupational risk prevention and improvement of work-related injury identification rules,so as to protect the right to occupational health and safety of workers.
