Research on Intellectual Property in the Development and Utilization of Beijing Olympic Archives
The legal development and effective utilization of Beijing Olympic archives is the basis for the construction of Beijing Olympic memory and the sustainable transmission of the Olympic legacy.Restricted by the IOC regulations,the development and utilization of Beijing Olympic archives are faced with the complex issue of Olympic intellectual properties,which makes it difficult to fully realize the multiple values of Beijing Olympic archives.This paper identifies and analyzes the intellectual properties of Beijing Olympic archives under the system framework of Olympic intellectual property,finds that not all intellectual properties of Beijing Olympic archives belong to the IOC,and proposes different development and utilization strategies for Beijing Olympic archives with different intellectual properties.For the Beijing Olympic archives that comply with the IOC's regulations,the development and utilization of such archives should take into account the international practice and the domestic reality,strengthen the consultation and communication,seek win-win cooperation,and encourage the development of public welfare.For the Beijing Olympic archives that comply with the relevant regulations of China,the intellectual property protection system of the Beijing Olympic archives should be established,and that system should follow the principle of balancing the interests of multiple social subjects,advocate the integration of"intent-procedure-results"evaluation,and adhere to the system of contractual licensing,with a view to realizing the multiple values of Beijing Olympic archives within the orbit of the rule of law for archives.
