我国网络空间治理立法的困境与对策

摘要
网络空间治理法治化是实现国家治理现代化的必然要求.经过 20 多年的实践探索,我国网络空间治理立法取得了较大成就,但仍存在体系性不足、操作性不强、私权保护不力、滞后性明显等问题.未来的网络空间治理立法需要转变立法思路,梳理现有法律法规,出台下位法,科学运用互联网技术,提升立法的体系性、可操作性和前瞻性,优化和完善我国网络空间治理法律体系,促进网络空间的健康有序发展.
Abstract
The rule of law in cyberspace governance is an inevitable requirement for the modernization of national governance.After more than 20 years of practice and exploration,China's cyberspace governance legislation has made great achievements,but there are still problems such as insufficient system,weak operability,ineffective protection of private rights,and obvious lag.Future legislation on cyberspace governance needs to change its legislative thinking,sort out existing laws and regulations,introduce lower laws,make scientific use of Internet technology,improve the systematical,operable and forward-looking legislation,optimize and improve China's cyberspace governance legal system,and promote the healthy and orderly development of cyberspace.
