The Endogenous Dilemma and Optimization Path of College Students
Hearings are the epitome of due process of law.The introduction of hearings into the internal management of colleges and universities is a useful attempt to legalize the management of students in universities,and is of great significance to balance the operation of power in colleges and universities and the protection of students'rights.At present,there are problems such as the confusion of functional positioning,the vague and narrow scope of application,and the lack of basic principles in the disciplinary punishment hearings of college students in China.In order to protect students'rights of defense and representation,the independent status of the hearing system should be established,the scope of application of student disciplinary punishment hearings should be broadened,the principle of openness of hearings and the principle of exclusivity of hearing transcripts should be established,and informal hearings should be introduced as an effective supplement to students'disciplinary punishment procedures.
