"Algorithm Selection of Takeout Platform:Institutional Logic and Normative Construction
The unary value orientation of takeaway platform algorithms has caused damages to the rights of riders and other stake-holders.The academic circle has formed many theories about algorithm governance of the delivery platform,such as efficiency theory,protection of the right to Know theory,protection of the right to democratic negotiation theory,protection of the labor rights and interests theory,and the interest balance theory.Based on the comprehensive absorption and reference of those various theories,system progress and platform practice,this research concludes that the algorithm selection of delivery platform is between labor benchmark as the bottom limit and efficiency standard as the upper limit.Within the range of upper and lower limits,the algorithm selection should fully measure the multiple values of the multiple stake-holders of the algorithm,reasonably protect the rights and interests of the rider in the individual dimension,give full play to the compliance responsibilities of the platform dimension,improve and coordinate the supply of legal norms such as Labor Standards Law,and establish professional algorithm evaluation and consultation institutions.Only by making full use of restriction,incentive and coordination mechanism and giving play to the initiative of multiple stake-holders,can we maintain the structural balance of various social values within the perspective of the algorithm.
