Legal Governance of Open-Source Artificial Intelligence Models
Open source is reshaping the industrial landscape and leading the innovation of business models.As an emerging field,artificial intelligence(AI)is rapidly developing by leveraging the resource aggregation capabilities and collaborative advantages of open source.However,the healthy and orderly development of AI in an open-source environment still encounters numerous challenges.Currently,issues surrounding open-source within the AI domain predominantly revolve around open-source AI models.Therefore,it is imperative to carefully evaluate their positive value and potential risks based on a clear understanding of the connotation and classification of open source artificial intelligence models.To construct a scientific,rigorous,and adaptable governance framework for open-source AI models,China should draw upon the existing experiences of other countries in this domain.This includes supporting the orderly development of open source,clarifying risk management obligations,promoting collaboration among diverse stakeholders,formulating a negative list,and fostering the formation of an international open-source AI alliance,thereby creating a fair and open-source ecosystem,and ensuring that the evolution of open-source AI models always remains anchored on a safe,controllable,legal,and compliant track.
