论反向行为保全的网络版权保护机制

摘要
通知—反通知程序的权利配置失衡与移除程序的法定义务化倾向,使得对恶意投诉、错误通知的反制偏离了平台治理的制度预设,倒向了司法提前介入的反向行为保全机制.反向行为保全所具有的深刻问题导向,决定了其不仅受制于诉前行为保全的程序性规定,更当服膺于网络侵权治理逻辑的实体性安排.前者呈现出及时原则与稳妥原则之间的张力,后者则蕴含了架空反通知程序、网络治理后置化的不安.因此,在对网络侵权算法化的治理中,反向行为保全机制难以取代通知规则下的平台治理而成为新的网络治理范式.
Abstract
The imbalance of the right allocation in the counter-notification procedure and the tendency of the statutory obligation of the removal procedure make the countermeasures against malicious complaints and false notices deviate from the institutional presuppositions of platform governance and turn to the reverse behavior preservation mechanism of judicial intervention in advance.At this point,the profound problem orientation of reverse conduct preservation determines that it is not only subject to the procedural provisions of pre-litigation conduct preservation,but also subject to the substantive arrangements of the logic of online infringement governance.The former presents the tension between the principle of timeliness and the principle of soundness,while the latter contains the uneasiness of disabling anti-notification procedures and post-governance of the network.Therefore,in the algorithmic governance of online infringement,the reverse behavior preservation mechanism is difficult to replace the platform governance under the notification rules and become a new network governance paradigm.
