人格权禁令的实体法视角检视及司法适用研究

摘要
置于实体法与程序法之下共同研究,是确立和实施人格权禁令的必然选择.人格权禁令作为民事实体法上的救济措施,它与专门针对家庭暴力案件的人身安全保护令之间,存在一般与特殊的适用关系;它具有事前预防功能,区别于人格侵权损害赔偿请求权的事后追溯性;它不属于人格权请求权的具体内容,虽然二者在功能方面存在一定的重叠,但不在同一程序轨道上运行.立法应当明确"人格权益"为人格权禁令的适用范围,且不以行为具有违法性为适用前提.人格权禁令在司法适用过程中要处理好程序效益与程序公正的关系,其体现出来的诉讼法理与非讼法理,决定了有必要构建一套独立的司法程序.该程序涉及的证据、担保、审查、执行以及程序性权利救济机制等问题,应紧紧围绕利益均衡原则展开.
Abstract
To establish and implement the prohibition of personality right,it is inevitable to study it under both substantive law and procedural law.As a remedy measure in the civil substantive law,the personal right injunction has a general and special application relationship with the personal security protection order specifically aimed at domestic violence cases.It has preventive function in advance,which is different from the retroactive right of claim for damages of personality tort.It does not belong to the specific content of the right of personality claim.Although there is a certain overlap in function,they do not run on the same program track.The legislation should clearly define"personality rights"as the scope of application of the personality right prohibition,and not take the illegality of the behavior as the premise of application.It is necessary to properly handle the relationship between procedural benefit and procedural justice in the process of judicial application of personality right injunction.The litigation and non-litigation jurisprudence reflected in the injunction determines that it is necessary to construct an independent judicial procedure.This procedure involving evidence,guarantee,examination,execution and procedural rights relief mechanism and other issues,should be closely developed around the principle of balance of interests.
