Protection of Workers'Privacy Rights in the Context of Widespread Application of Biometrics Technology——Taking Face Recognition Technology as an Example
Biological information such as face recognition information of workers generated in labor scenarios has the attribute of object of privacy and belongs to the object of privacy protection.Accompanied by face recognition technology and other biotechnology to complete the technological leap from identification to identification analysis,coupled with the legislative defects in the regulation of face recognition technology and labor norms on the protection of privacy and other factors,the protection of the right to privacy of the workers are facing protection dilemmas,the core reason for this is that face recognition technology exacerbates the conflict between the management right of the employing unit and the right to privacy of the workers,and this contradiction is reconciled for the reason based on the concept of reasonable privacy and expectation theory and scene-oriented concept of dynamic factor theory to propose legal principles and theoretical application of the real conflict.The Dynamic Factor Theory of Expectation Theory and Scenario-Oriented Concept Proposes Legal Principles and Theoretical Applications to Realistic Conflicts.
