The Criminal Risks of Internet Equity Crowdfunding and the Construction of Regulatory Types——From the Perspective of Criminal Law Rationality
Under the policy guidance of encouraging and supporting the development of private enterprises,internet equity crowdfunding has important value today.However,due to the lack of regulatory laws and the need for improved models,the"barbaric growth"of internet equity crowdfunding may trigger various criminal risks,but blindly using criminal law is not an appropriate choice.The rationality of criminal law in contemporary society consists of the theory of risk society and the concept of misdemeanor governance.Based on the rational thinking of criminal law,different behaviors should be classified and regulated:the types of behaviors that are not worthy of criminal punishment should be criminalized and regulated using pre-existing legal norms;behavior types with limited legal infringement should be provided lenient punishment;behavior types that may further trigger serious social risks should be imposed heavier penalties,ensuring the healthy and orderly development of internet equity crowdfunding on the track of the rule of law.
