元宇宙消费场景中金融信息利益识别与迭代保护

摘要
法益的概念在沟通法律体系和法学方法论中发挥着重要作用,应当贯彻到元宇宙消费场景的金融信息利益保护中.法益的概念也具有现象、价值和方法的作用,可以帮助人们更好地理解和保护金融信息利益.金融信息是消费者精神追求的外化,也是金融活动的本源与核心,需要准确识别、迭代保护.识别元宇宙消费场景中的金融信息利益,应当把握价值性、现实性和混空间性三个主要特质.为了迭代保护金融信息利益,应审慎立法,专注于以消费者、用户为核心的价值维护.同时,需要新建归责原理、避免"长臂管辖",另辟金融信息保护路径.只有这样,才能更好地保护消费者的合法权益,促进元宇宙金融市场的健康发展.
Abstract
The concept of legal interest plays an important role in communicating legal systems and legal methodology,and should therefore be implemented in the protection of financial information interests in metaverse consumer scenarios.The concept of legal interest also serves as a phenomenon,a value and a methodology to help people better understand and protect financial in-formation interests.Financial information is the externalization of consumers'spiritual pursuits and the origin and core of finan-cial activities,which needs accurate identification and iterative protection.To identify the financial information interests in meta-verse's consumption scenarios,we should grasp three main characteristics:value,reality,and mixed space.In order to protect the interests of financial information in an iterative manner,legislation should be enacted in a prudent manner,focusing on the preservation of consumer-centered and user-centered values.At the same time,there is a need for a new imputation principle,avoidance of"long-arm jurisdiction",and the creation of alternative paths for the protection of financial information.Only in this way can we better protect the legitimate rights and interests of consumers and promote the healthy development of the financial market in the metaverse.
