党内法规程序性条款文本质量提升研究——基于法规文本的统计分析

摘要
党内法规的程序性条款是确保党内各项实体性规范得以严格执行和全面落实的重要内容,是贯彻落实全面从严治党、依规治党的具体遵循.通过对党中央制定的党内法规文本进行统计分析,发现目前存在程序性条款占比较少、层级较低、执行力较差、重点领域配套程序性条款内容亟待完善、违反程序性条款的制裁制度缺失等问题,应当在现行法规基础上清理冗余条款,构建科学多层次的程序性条款体系,完善配套程序性条款的具体流程,细化权利救济性条款,增强重点领域法规实效,加大对违反程序性条款的制裁力度,全面提升程序性条款的文本质量.
Abstract
The procedural provisions of intra-party regulations are important contents to ensure the strict and full implementation of the substantive norms within the Party,and as well the specific compliance to implement the comprehensive and strict Party governance according to rules.Through the analysis of the text of intra-party regulations formulated by the central government,it is found that there are some existing problems,including procedural clauses are in less proportion,low level and poor execution;further,urgent improvement on the content of supporting procedural clauses in key areas are badly in need,and sanction system for violating procedural clauses are in absence.Therefore,it is necessary to clear up redundant clauses on the basis of existing regulations and build up a scientific and multi-level procedural clause system.We should improve the specific procedures for supporting procedural provisions,refine the provisions for remedy of rights,enhance the effectiveness of laws and regulations in key areas,and intensify sanctions against violations of procedural provisions in order to comprehensively improve the quality of procedural provisions.
