民法典时代不动产谦抑适用善意取得的司法续造

2007 年的《物权法》确立了优先保护第三人的不动产善意取得制度,司法实践中有粗放、机械适用情形,不当损害了原权利人利益.民法典时代,不动产善意取得制度在立法未变的前提下,为实现原权利人与第三人的利益平衡,司法续造必不可少.续造的核心是进一步厘清适用要件的认定标准,如限缩无处分权人为表见权利人,明确合同有效是适用前提,确定合理价格的要素等,严格遵循"非吻合,不适用"的谦抑精神.
Judicial Renewal of Bona fide Acquisition of Real Estate for Modest Application in the Era of Civil Code
In 2007,The Property Law made it clear that the system of Bona fide acquisition of immovable property by third parties was protected,but there were extensive and mechanical application cases in judicial practice,which often improperly damaged the interests of the original right holder.In the era of Civil Code,under the premise of unchanged legislation,the system of Bona fide acquisition of real estate is necessary to achieve the balance of interests between the original right holder and the third party.The core of the continuous construction is to further clarify the identification criteria of the applicable requirements,such as restricting that a person has no right to dispose of is an apparent right holder,clarifying that the validity of the contract is the premise of application,determining the elements of reasonable prices,and strictly following the modest spirit of"not a match,not applicable".
