摘要
企业数据的价值属性日益突出,但企业数据权益保护的统一规则尚未在立法层面予以明确.在企业数据权益保护方面,竞争法有着相对明确的规则,在企业数据权益纠纷的司法实务中具有较强的可操作性,并具备理论和现实层面的适用合理性.竞争法保护模式拥有独特的优势,但为了实现保护效果的最大化,有必要对竞争法保护所存在的困境作出回应.
Abstract
The value attribute of enterprise data is increasingly prominent,but the unified rules for the protection of enterprise data rights and interests have not been clarified at the legislative level.In terms of the protection of enter-prise data rights and interests,the Competition Law has relatively clear rules,and has strong operability in the judi-cial practice of enterprise data rights and interests disputes,and has theoretical and practical application rationality.Competition Law protection mode has unique advantages,but in order to maximize the effect of protection,it is nec-essary to respond to the dilemma of Competition Law protection.
