摘要
"因人立法"是民国初期一大公案,本是袁世凯攻击《临时约法》的借口,但当年政界和学界一些有影响的人士被袁世凯的说词所蒙蔽,并为其所利用.《临时约法》所确立的不是误传的内阁制,而是总统制.袁世凯指责《临时约法》属于"因人立法",完全是为了将来弃用《临时约法》制造社会舆论.
Abstract
The issue of"legislation for person"was a significant controversy in the early years of the Republic of China.Initially,it was used by Yuan Shikai as a pretext to attack the Provisional Constitution of the Republic of China.However,some influential figures in politics and academia were deceived by Yuan's arguments and even manipulated by him.The governmental system established by the Provisional Constitution was actually a presidential systembut mistaken for a cabinet one.The reason why Yuan Shikai accused the Provisional Constitution of being"legislation for person"was entirely to create public opinion for the abolition of the Provisional Constitution in the future.
