A Historical Review and Analysis of"Amendment to Laws Based on Cases"in Judicial Practices in the Qing Dynasty:Take QiliBeng'a Case During Daoguang's Reign as an Example
The QiliBeng'a Case in 1824 prompted the Ministry of Justice to revise the relevant regulations in the"Criminal Law-As-sault-Assaulting Parents and Elders"section in the Great Qing Code twice,respectively in 1824 and 1834.These revisions triggered at-tention and debates within the imperial court.The amendment process around the QiliBeng'a Case reflects the traditional principle of le-gal obedience and the dominant influence of Confucianism in the society,and shows that the legal system in the Qing Dynasty could a-chieve balanced self-regulation.
