网络爬虫技术在刑事合规视阈下的风险预防

摘要
作为数据抓取工具的网络爬虫技术在促进企业数字化发展方面具有独特优势,但囿于技术的双面性,其恶意使用行为也使得个人信息安全、作品知识产权、网络空间的秩序稳定状态隐患重叠,单位犯罪屡屡发生.然而我国司法实践中对该技术的法律规制还存在司法评价混乱和司法评价扩大化倾向等困境,极易导致"办理一起案件,垮掉一个企业,失业一批员工"的社会负面效应,这与我国保护民营经济发展的政策无法同频.对此,国家应跳出传统刑法以惩罚性打击犯罪为主的单一规制桎梏,转而以风险预防为主.是故,将刑事合规思路引入网络爬虫犯罪的治理为最佳选择.企业应结合爬虫技术自身特点,精准识别刑事法律风险并建立相应的合规规则.
Abstract
As a data capture tool,web crawling technology has special advantages in promoting companies'digitalized development.However,based on the two-sided nature of technology,the malicious application might cause a lot of hidden dangers for personal infor-mation security,intellectual property rights and order of cyberspace,causing more unit crimes.In the judicial practice in China,the as-sessment for the legal regulation of this technology is unsystematic and tends to expand.These dilemmas easily cause the problem that to process one case might destroy a company and cause many staff unemployed,which is incompatible with the policy to protect non-state-operated economy development in China.For that,it is recommended to emphasis risk prevention rather than fighting crimes punitively.Therefore,it's the best choice to introduce criminal compliance to management of web crawling crimes.Companies should precisely iden-tify the criminal risks and construct the corresponding compliance rules based on the characteristics of crawling technology.
