Improvement of the Disciplinary System of Administrative Penalties for Public Security in the Perspective of the Revised Law of the People's Republic of China on Administrative Penalty
On the revision occasion of the Law of the People's Republic of China on Administrative Penalties for Public Security,the revised Law of the People's Republic of China on Administrative Penalty creates new requirements for the improvement of the disciplinary system of administrative penalties for public security,and also provides legal reference for the censorship of subordinate legal measures of administrative penalties for public security.According to the revised Administrative Penalty Law,the disciplinary system of administra-tive penalties for public security should be improved as follows:to strength prevention by proactive education and strengthen comprehen-sive management;to increase reprimand penalties which are more cautionary;to add prohibitive penalties with the function of restricting and isolating offenders;to set up a progressive penalty system which will strengthen the management process of business activities;to add non-punitive measures such as social service orders;to introduce community correction and other social care ideas;and to rationally allocate the types of public security management penalties and their subordinate legal measures.
