An Analysis on the Refusal of Bail for Medical Parole of Detained Criminals:Based on the Comprehensive Motivation Theory
Medical parole,as a form of execution outside prison,is of great significance to protecting the human rights of criminals,influencing criminals to actively reform,enabling them to return to their families as soon as possible,and creating a harmonious society while ensuring that criminals receive medical care during their detention.In practice,detained criminals who suffer from serious illnesses requiring medical parole often encounter the dilemma of their family members'refusal of bail.Based on the comprehensive motivation theory,the reasons for the refusal are analyzed from two major factors:internal and external factors.It is found that the responsibilities of guarantors,guarantee methods,and execution methods and mechanisms need to be clarified and improved.In response to these prob-lems,solutions are proposed,such as strengthening the education and publicity of guarantors,increasing guarantee methods,changing the execution methods of medical parole,and improving the medical parole mechanism for criminal patients,so as to promote the smooth im-plementation of medical parole.
