Research on the Criminal Patterns of Internet Troll Army and the Judicial Responses
Through the continuous updating and iteration of technology,the internet troll army has become an illegal and criminal industry chain with a clear hierarchy,complete categories and professional means,and are organized,profit-oriented and illegal.Accord-ing to the operation mode and purpose,the internet troll army can be divided into the categories of fake engagement and evaluation con-trol,attracting followers with rumours,extortion based on public opinions,and charging for view deletion or posting online.At present,in the face of the criminal patterns of the internet troll army,the judicial responses are still insufficient:internet troll army shows ambiguity in their contacts,thus it's difficult to identify the knowledge determination and the division of principal and accessory;it's difficult to de-fine the crime and identify the amount of the crime;it's difficult to fix evidence and the professional investigation capacity is insuffi-cient;and the administrative-criminal coherence is poor.To address the above problems,firstly,a multi-departmental joint mechanism can be established and the responsibility of platforms and netizens can be strengthened so as to provide a guarantee for reducing con-flicts during law enforcement and lowering the crime rates;secondly,the appropriate law enforcement measures can be adopted according to the consequences and the capacity of digital forensics can be improved so as to improve the accuracy of the judicial trials;thirdly,an administrative-criminal coherence mechanism should be established to improve the relevant legal regulation paths;and lastly,what crimes and how many crimes should be identified reasonably according to the essential attributes of an illegal act extracted from the sci-entific application of criminal law theories and combining it with practical experience,so as to achieve the proportionality of crime and punishment.
