Analysis on the Localized Application of Malicious Complement Age Rule
China's social governance is currently faced with vicious offences committed by underage minors which is an increasing-ly serious challenge.In response to this problem,common law countries apply the malicious complement age rule,and after centuries of development,this rule has been relatively perfect.China can draw references from this rule on the aspect of constraints on the specific age group of juvenile defendants under certain circumstances.Taking the evolution and application conditions of the malicious comple-ment age rule as the perspective,this paper analyzes the necessity of sanction strengthening and expectation balance,and the feasibility of cultural inheritance and social environment,and puts forward a specific path to achieve the localization of this rule,so as to provide assistance for China to balance the interests concerning many parties and improve the governance towards juvenile delinquency.
