A Study on the Causes of and Countermeasures Against Misjudged Criminal Cases at the Investigation Stage
Misjudged criminal cases may concern every citizen;the study of its causes and countermeasures has positive practical significance and deep academic significance.At present,the deep-rooted objective causes of misjudged criminal cases are less dis-cussed theoretically in China,especially concerning the epistemological and methodological constraints,as well as more concerns on correction afterwards than prevention and controlling beforehand.By introducing its concept and the universal factors causing errors,this study firstly focuses on the causes of misjudged criminal cases,and then put forward the corresponding suggestions to construct a prevention system for misjudged criminal cases in China from four aspects concerning legislation,system,management model and the corrective and preventive mechanism.
