我国乡村法治建设的改革演进与思考——以1949～2022年的涉农法律法规文本分析视角

摘要
为分析新中国成立后乡村法治建设的发展进程和成就以及在发展中存在的问题,以1949～2022年乡村法治建设的历史实践为主要研究对象,使用文本分析法、历史研究法等研究方法,总结不同时期的乡村法治建设成就.第一阶段为新中国成立后到改革开放前夕(1949～1978年),这一时期的法治发展具有阶级性的特点;第二阶段为改革开放后至党的十八大前夕(1978～2012年),这一时期的乡村法治建设发展具有与政策紧密结合的特点;第三阶段是新时代的乡村法治建设(2012年至今),新时代的乡村法治建设具有极大丰富性、体系化的特点.乡村法治建设快速发展的成就有涉农立法工作的完善、司法活动的丰富、农民法治意识的提升,但同时乡村法治建设面临立法繁多,缺乏体系;缺乏监督,信息封闭;专业不足,缺乏认知等问题.对此,提出完善立法体系,丰富农村法治;明确治理结构,强化法治监督;加强普法活动,加强法治教育等对策建议,以期为促进乡村法治建设提供有益借鉴.
Abstract
In order to analyze the development process,achievements,and existing issues of rule of law construction in rural China since its founding,this study focuses on the historical practices of rule of law construction in rural China from 1949 to 2022.This research utilizes methods such as textual analysis and historical research to summarize the achievements of rule of law construction in different periods in rural China.The first phase was after the establishment of New China up to the eve of the reform and opening-up(1949-1978),where law construction in rural China had characteristics of class distinctions;the second phase was from after the reform and opening-up to the eve of the 18th National Congress of the Communist Party of China(1978-2012),where law construction in rural China was closely integrated with policies;the third phase has been since 2012,which is the new era for law construction in rural China(2012-),exhibiting great richness and systematic qualities.The construction of law rural China has developed rapidly and achieved numerous accomplishments,yet it also faces multiple challenges such as the lack of systematization in legislation,insufficient supervision,and inadequate professionalism.To promote law construction in rural China,this study proposes following suggestions:perfect the legislative system to enrich rural law system;clarify governance structures to strengthen legal supervision;enhance legal awareness and promote legal education.
