整体法秩序下元宇宙赋能竞技体育的治理路径

在元宇宙赋能的背景下,竞技体育基于信息技术集合,形成现实体育与虚拟体育空间融合的体育新业态,竞技体育迎来发展的时代新机遇.研究发现,在展望元宇宙赋能竞技体育带来的新图景时,还应关注元宇宙可能对体育本质、数据安全以及公正秩序带来的潜在风险.通过规范分析方法,借整体法秩序对竞技体育的相关规定,如以人民为中心保障运动员身心健康、合规治理保障数据安全、规范赛事管理保障公正秩序等,为规避元宇宙赋能竞技体育的潜在风险提供相应指导.在此基础上,为使整体法秩序更好地保障元宇宙赋能竞技体育,提出在现有立法基础上进一步强化元宇宙赋能竞技体育的"软法之治"、完善数据安全规制体系、加强专门人才的培养与技术研发等具体建议,为元宇宙赋能竞技体育提供具体可行的治理路径.
Governance Paths of Metaverse Empowering Competitive Sports Under the Overall Legal Order
In the context of metaverse empowerment,competitive sports,based on the collection of information technology,forms a new sports format integrating real sports and virtual sports space,and competitive sports meet the new opportunities for development.The study finds that when the new landscape of metaverses empowering competitive sports reveal,attention should also be paid to the potential risks that metaverses may pose to the nature of sport,data security and just order.Through normative analysis methods,by means of the relevant provisions of the overall legal order for competitive sports,such as people-centered idea to protect athletes'physical and mental health,compliance governance to ensure data security,standardized event management to ensure fair order,etc.,this study provides the corresponding guidance to avoid the potential risks of metaverse empowering competitive sports.On this basis,in order to make the overall legal order better protect the process of metaverse empowering competitive sports,it suggests to further strengthen the"soft law rule"of metaverse empowering competitive sports on the basis of existing legislation,to improve the data security regulation system,and to strengthen the training of specialized talents and the research and development of technology,so as to provide concrete and feasible governance paths for metaverse empowering competitive sports.
